Terms of Purchase and Use
1. General provisions
1.1. This agreement is binding on both parties and governs the rights and obligations of the buyer and seller, terms of purchase and payment of goods, delivery and return of goods, responsibilities of the parties and other terms and conditions relating to purchases and sales made from SIA “Art Platz”, Registration No. 40203166243, adress: Alberta street 4-9, Riga, LV-1010 (hereinafter – Seller).
1.2. The Buyer agrees to the Terms of Purchase and Use by confirming it when placing an order in the online store or by registering on the online store.
1.3. The Seller has the right to change Terms of Purchase and Use, taking into account the legal requirements. The buyer will be informed about that when using the online store artoftea.lv or by e-mail.
2. Buying/Selling
2.1. The purchase/sale agreement is concluded when the Buyer:
2.1.1. Confirms the purchase in the online store (Buyer is informed about purchase by e-mail);
2.1.2. Confirms the purchase by phone, indicating the delivery address, name and surname and at the time when the courier document is signed (delivery receipt, electronically signing at the terminal or otherwise – depending on the courier’s requirements).
2.2. If the product selected by the Buyer is not available in the warehouse after the placement of the order, it will be automatically cancelled and the Buyer will be notified by e-mail, prior the amount payable for the unavailable product is returned.
3. Rights and obligations of the Buyer
3.1. The Buyer must pay for the goods in accordance with the terms of payment.
3.2. The Buyer undertakes to comply with the terms described in the online store and with the legislation of the Republic of Latvia.
3.3. If the Buyer fails to fulfil its obligations, the Seller has the right to immediately and without prior notice, limit or terminate the cooperation with the Buyer.
4. Rights and obligations of the Seller
4.1. The Seller has the right to cancel the Buyer’s order if the Seller cannot contact the Buyer within 3 (three) working days, according to the contacts indicated by the Buyer.
4.2. The Seller undertakes to respect the Buyer’s right to data privacy, in accordance with the legislation of the Republic of Latvia.
4.3. If the Seller is unable to fulfil the Buyer’s order (deliver the goods on time and / or deliver exactly the goods ordered by the Buyer, then the Buyer has the right to return / cancel this order and the Seller must return the money to the buyer within 3 (three) working days), if the Buyer has already paid the Seller. The exception is if the Buyer and the Seller have agreed on a different delivery time or exchange of the goods.
5. Return of goods
5.1. The Buyer is entitled to use his right of withdrawal and return the purchased product within 14 (fourteen) days, taking into account the following terms:
5.1.1. Informing the Seller about this decision by submitting a written application to the Seller;
5.1.2. delivering the product to Art Platz Ltd., Alberta Street 4-9, Riga, LV-1010, not later than within five working days after submission of the application to the Seller;
5.1.3. Buyer shall cover the costs of returning the goods to the online store;
5.1.4. Delivering the goods in the original packaging, unused, in the same condition as it was purchased, not damaged and with its appearance not changed significantly. The product shall not be returned for hygiene or health reasons.
5.2. The Seller is obliged to return to the Buyer the full amount of the price paid for the goods in the amount of 100%, transferring it within 30 (thirty) days to the bank account indicated by the Buyer (in the application for return of the goods), minus delivery costs, if any.
6. Delivery and payment terms
6.1. Delivery of orders is possible by collecting the product on the spot at the office of SIA “Art Platz” at Alberta Street 4-9, Riga, free of charge or by a courier or by courier services inside the territory of Latvia, Estonia, Lithuania, Finlandia and Poland for a fee.
6.2. When placing and paying for the order, you will receive the product within the next 5 working days.
6.3. Payment for the order is possible in cash at the office in Alberta Street 4-9, Riga, by bank transfer, by paying the received pre-payment invoice or by making a card or automatic internet banking payment.
6.4. The Buyer receives the original receipt of the order together with the ordered goods.
7. Price
7.1. Payment currency in the online store is EUR (euros). The indicated prices include all expected taxes in Latvia, but do not include delivery costs. Shipping costs are added to the total price as indicated in the section – Shipping costs.
7.2. Bank card payments are protected by a secure SSL (Secure Socket Layer) protocol.
7.3. We use the online payment system of A/S “Swedbank” for payments in the online store.
7.4. Prices are subject to change at any time. However the changes do not affect orders for which we have sent an Order Confirmation.
8. Coupon terms of use
8.1. The coupon allows the Buyer to purchase the goods at a discount price within the specified period.
8.2. The coupon code may not work if the product is already set to one of the discount options, for example, it is already a promotional product with a special price.
8.3. Discount coupon codes can be sent to a customer’s email, published on an online store, on social media sites, or in another public spaces.
9. Data processing
9.1. The information or personal data you provide to us is processed in accordance with the Personal Data and Cookies Policy. By using this website, you consent to the processing of your information and data and you ensure that all the information and data provided is true and correct.
10. Warranties
10.1. If you have changed your mind and decided to withdraw from the purchase, the Consumer Rights Protection Law of the Republic of Latvia (CRPL) and the Cabinet Regulation No. 255 “Regulations on Distance Contracts” (Cabinet Regulation No. 255) stipulate that the buyer has the right to withdraw from the contract within 14 calendar days and return the product purchased in the online store to the seller. Article 12 (6) of the CRPL provides that, in the case of a distance contract, “the consumer is responsible for maintaining the quality and safety of the goods during the period of exercise of the right of withdrawal”. We recommend keeping the original packaging of the product, so that when exercising the right of withdrawal in accordance with the provisions of the Distance Agreement, the product is not mechanically damaged externally and electronic equipment is not used.
10.2. SIA “Art Platz” has the right to refuse to accept a returned product that is damaged, used or not complete. To agree on the return of the product, please contact us by e-mail: artoftea.clients@platzkart.shop or by phone: +371 20025002, indicating the date and number of the order.
10.3. If the product has technical problems during the use of the product, the service of the product will be performed in accordance with the provisions of the Consumer Rights Protection Law of the Republic of Latvia (CRPL). The service time of the product is indicated in its description. Purchase documents are valid only if they correctly and clearly indicate: product name, article, date of sale, purchase document number. It is forbidden to make any changes, delete or overwrite the data indicated in the purchase documents – in this case, the service documents will be declared invalid. We remind you that CRPL norms do not apply in cases when the product is purchased by legal entities.
10.4. Complaints received regarding the quality of the product will be resolved in accordance with the norms of the Consumer Rights Protection Law of the Republic of Latvia (CRPL), in accordance with the regulations of the Cabinet of Ministers No. 631. “Procedures for Applying for and Examining a Consumer’s Claim for a Goods or Services Not Conforming to the Provisions of the Contract” (Cabinet Regulation No. 631).
10.5. The Seller is not responsible for losses incurred by the Buyer due to incorrect or reckless use of the product.
11. Claims
11.1. Parties agree to settle all disputes or disagreements, if any, arising out of these Terms of Purchase, through negotiations. If it is not possible to resolve disputes through negotiation, they will be submitted to the Riga Arbitration Court.
